As you may know, I am in support of a local legal expert, Carl Olsen, a regular guy who just happens to have been busted for something to do with twenty tons or so of reefer and got to be a legal sharpie in ye gaol. I am going to do something I totally promise you is extreamly rare: I am going to solicit money for him. It is hard to be more out of cash than your humble narrator is so if I can kick this guy $50 won't you please consider $5 to help bring freedom's champion, Carl Olsen, some money to fight these authority loving creeps with? It is how the lawyers control us out of the legal process and we can not allow that to be so! We need to get cannabis legal and to do that we need to force the dea creeps to re schedule cannabis out of schedule one where they use it to destroy over 800,000 people a year! They do not do this because they love justice! They love controling other people and need tossed off the public retirement roles as unnecessary, outmoded expenses. We do not need to hurt people for possessing pot! These people get paid huge money to hurt people for possessing pot. Therefore, we do not need these federal employees who hurt us for smoking or possessing pot and they need to be fired immediately. Let's help Carl get these federal assholes fired like they need to be.

EAT THIS MCSHAME: Federal war on medical pot challenged Bob Egelko, Chronicle Staff Writer Thursday, August 21, 2008 -------------------------------------------------------------------------------- -------------------------------------------------------------------------------- A federal judge breathed new life Wednesday into medical marijuana advocates' effort to ward off the federal crackdown on medical pot in California, saying enforcement of U.S. drug laws can go too far if it seeks to interfere with state authority. -------------------------------------------------------------------------------- U.S. District Judge Jeremy Fogel of San Jose denied a Bush administration request to dismiss a lawsuit by Santa Cruz city and county officials and members of a medical marijuana collective whose drugs were seized by federal agents in a 2002 raid. The Santa Cruz raid was one of many actions by federal authorities against suppliers of marijuana in California since the state's voters approved a 1996 initiative allowing individuals to grow and use pot with their doctors' approval. Federal prosecutors have shut down medical marijuana dispensaries, threatened to sue the dispensaries' landlords, won convictions against growers for violating federal narcotics laws and sought to punish doctors for recommending marijuana. The U.S. Supreme Court and other courts have upheld the federal actions, except for the government's attempt to strip federal prescription licenses from the doctors. But Fogel said the plaintiffs in the current case may be able to show that the federal government exceeded its constitutional authority by trying to force California to repeal its medical marijuana law. The suit claims federal prosecutors have tried to disrupt the California law by enforcement that targeted critical participants in the state system - doctors who approved their patients' marijuana use, local officials who issued state-approved identification cards to medical marijuana users, local governments whose zoning allowed pot dispensaries, and marijuana suppliers who cooperated with local governments. Federal authorities' goal, the plaintiffs alleged, is to make it impossible for the state to distinguish between medical and recreational use of marijuana and render the state law unenforceable, interfering with California's constitutional power to enact its own laws. Government lawyers denied any such intention and said the suit was baseless. Neither the federal drug law nor any enforcement action has required the state to change its marijuana law or enforce federal laws, they said. The suit, if successful, "would unlawfully inject the courts into considerations of how the government is enforcing federal law, matters which the Constitution vests in the executive branch," Justice Department lawyers said in court papers. But Fogel said Wednesday that if the plaintiffs can prove all their claims, "they may be able to show that (federal officials) are deliberately seeking to frustrate the state's ability to determine whether an individual's use of marijuana is permissible under California law." He cited an opinion by Judge Alex Kozinski of the Ninth U.S. Circuit Court of Appeals in San Francisco in the 2002 ruling on doctors who recommended marijuana. Although the federal government may prefer that California prohibit medical marijuana, Kozinski said, "it cannot force the state to do so." Medical marijuana advocates and their lawyers called the ruling a potential breakthrough. "For the first time, a court has recognized that a calculated plan by the federal government to undercut state medical marijuana laws is patently unconstitutional," said Graham Boyd, an American Civil Liberties Union lawyer. yep, that is a quote from my home state Republican senator. Here, with small revisions that will be obvious, is an otherwise verbatum quote of his most recent letter to your humble narrator: Dear Mr. SuckMeBush: Thank you for your correspondence supporting the legalization of marijuana for medical pruposes. As your Senator, it is important for me to hear from all Iowans on issues that are important to you. I must, however, disagree with your view that marijuana should be legalized for medical purposes. Marijuana is illegal because it is dangerous. When you smoke marijuana, or use any other drug, it changes yur brain. It changes the way you think, your ability to learn, and how well you can remember. Making Marijuana a legal drug will not change any of this. the laws granting the federal government the authority over the movement and sale of these dangerous substances is well established and has been thoroughly reviewed by the courts. Over 15,000 scientific, peer-reviewed studies into the medicinal value of marijuana have been published. Not one demonstrates that marijuana has any medicinal value for any condition. Indeed, there is medical evidence to suggest that marijuana may actually aggravate some of the conditions it is supposed to treat, such as glaucoma or wasting.  Americans today have the world's safest, most effective system of medical practice, built on a process of scientific research, testing and oversight that is unequaled. Every drug prescribed as medicine in this country must be tested according to scientifically rigorous protocols to ensure that it is safe and effective before it can be sold. Legalizing marijuana through the political process bypasses the safeguards established by the FDA to protect the public from dangerous or ineffective drugs. It is also important to point out that for every instance claimed as a use for marijuana, there is a far better, legitimate, scientifically approved medication. this includes Marinol, which is a legally available, FDA-approved form of a marijuana extract that is currently being used as a treatment for nausea and AIDS wasting syndrome. Many other medicines have been developed and have received FDA approval that do not have the hallucinogenic side effects that come with smoking marijuana. these are medicines that meet scientific standards and do not rely on sanecdotes and testimony for validation. Certainly, I want to provide relief for people who are sick and dying. Should research someday prove that smoking marijuana does have medicinal value, I would support its use for medical purposes. But, even then,it should occur only under proper medical supervision and should conform to the prescription procedures under which other medicines are administered.  Thank you again for contacting me.
